Welcome to TINTAShift! These Terms of Service (“Terms”) constitute a binding agreement between you (“User” or “you”) and Prism Institute (Shanghai) Co., Ltd. (上海棱境工坊科技有限公司) (“TINTAShift,” “we,” or “us”) regarding your access to and use of this Website, account registration, purchases, and related services.

Please read these Terms carefully. By accessing the Website, registering, submitting orders, or completing a purchase, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Website or related services.

1. Eligibility

Products and services on this Website are offered only to natural persons aged 18 or older with full civil capacity. If you use the site on behalf of a company or organization, you represent that you are duly authorized. Minors may not register, place orders, or purchase beauty products on this Website.

2. Accounts

2.1 Registration

You must provide true, accurate, and valid information when registering. You may not impersonate others. You are responsible for safeguarding your password and for all activities under your account.

2.2 Security

If you notice unauthorized access or suspicious activity, change your password immediately and notify us. We are not liable for losses caused by your failure to protect credentials, sharing accounts, or disclosing passwords.

2.3 Termination

You may request account deletion at any time. We may suspend, freeze, or permanently close accounts for abusive orders, malicious after-sales conduct, infringement, illegal use, or other violations.

3. Products and orders

3.1 Product descriptions

TINTAShift offers state-switchable chromatic surface technology beauty products, including TINTA MUSE, TINTA ICON, TINTA SPOTLIGHT, TINTA CHAPTER, and TINTA SIGNATURE. We strive to ensure descriptions, specifications, and prices are accurate. Product images are professionally color-corrected; minor color differences due to displays or lighting are normal and not quality defects. If a color discrepancy materially affects core use, contact us to resolve.

3.2 Order formation and cancellation

After you submit an order and complete payment, the sales contract is formed. We may cancel orders only in lawful circumstances such as severe stock shortage, pricing errors, abusive bulk orders, or prohibited transactions, and will refund the full amount to the original payment method.

3.3 Pricing and payment

Prices are as displayed in the currency shown on the site and exclude international shipping, duties, and clearance fees unless stated. Payments are processed by qualified third-party providers; we do not retain sensitive payment credentials.

4. Shipping and delivery

4.1 Coverage

We ship to many regions worldwide; eligible destinations are shown at checkout.

4.2 Timelines

Stated shipping and delivery times are estimates only and may be delayed by customs, carrier congestion, force majeure, or other factors—they are not guaranteed delivery dates.

4.3 Risk transfer

After goods are handed to the carrier, risk of loss or damage in transit passes to you unless mandatory law provides otherwise. If packaging is damaged at delivery, photograph the issue and contact customer service promptly.

4.4 International duties and taxes

Import duties, VAT, clearance fees, and similar charges in the destination country are borne by the recipient unless otherwise stated. Amounts and thresholds vary; you may estimate duties via customs resources before purchase. If you refuse delivery or abandon a shipment, you bear return shipping and any secondary fees; we are not responsible for costs arising from refusal or abandonment.

5. Returns (consumer protection)

5.1 Eligibility

Within 30 days of receipt, you may request a no-reason return if the product is unopened, unused, complete with accessories and packaging. For hygiene reasons, opened or used beauty products are not eligible for no-reason returns. If you opened packaging only as reasonably necessary for inspection and the goods remain in merchantable condition, no-reason return may still apply. Customized, personalized, or clearance items marked “final sale” are not eligible; the checkout flow will prompt you to confirm such restrictions before purchase.

5.2 Defects vs. preference

We provide free returns or exchanges for defects, wrong items, missing items, or damage for which we are responsible. Subjective reasons (preference, expected color, scent) are not quality defects; return shipping is your cost.

5.3 Process

Contact customer service for return authorization before shipping items back so we can provide the correct address and instructions. Unauthorized returns may delay refunds if we cannot match your order. After we receive and verify the goods, refunds are processed within 7–15 business days to the original payment method.

5.4 Shipping costs

For our fault: we bear round-trip shipping. For customer convenience returns: outbound return shipping and any original outbound shipping charges already paid are non-refundable as applicable.

6. Intellectual property

All text, images, video, logos, trademarks, product design, copy, and layout on this Website are the exclusive intellectual property of Prism Institute (Shanghai) Co., Ltd. (上海棱境工坊科技有限公司) and are protected under Chinese and international copyright and trademark law.

Without our written authorization, no party may copy, misappropriate, alter, redistribute, or use our materials for commercial diversion; violators may face legal action.

7. Acceptable use

You must not use the Website to violate laws or third-party rights, upload malware, use bots to scrape or overload the site, attack or exploit vulnerabilities, post false or misleading reviews, or conduct unauthorized commercial promotion. We may apply technical restrictions and reserve legal remedies.

8. Disclaimer

To the extent permitted by law, we are not liable for losses caused by force majeure (natural disasters, epidemics, customs holds, policy changes, carrier stoppages), third-party service failures, or your own errors.

The Website is provided “as is” without implied warranties beyond what the law requires; we do not disclaim liability for intentional misconduct, gross negligence, or personal injury and property damage where prohibited.

9. Limitation of liability

Except where prohibited, our liability for ordinary negligence is limited to the amount you paid for the relevant order. This does not limit mandatory consumer rights, personal injury, or gross negligence where the law forbids exclusion.

10. Indemnity

If your misuse of the Website, infringement, or breach of these Terms causes claims, losses, or costs to us, partners, or third parties, you agree to indemnify us, including reasonable attorneys’ fees and enforcement costs.

12. Governing law and disputes

These Terms are governed by the laws of the People’s Republic of China. Parties shall first seek amicable resolution; if that fails, disputes may be submitted to a competent people’s court at the defendant’s domicile or the consumer’s delivery address. Mandatory consumer rights in the EU and other regions remain unaffected where applicable.

13. Changes to the Terms

We may revise these Terms as laws or our business evolve. Updates will be posted with a new date; material changes may be announced in advance. Continued use constitutes acceptance unless the law requires otherwise.

14. Severability

If any provision is held invalid or unenforceable, the parties will seek a valid substitute that reflects the original intent to the maximum extent permitted; remaining provisions remain in effect.
